1. Purpose and seller identity
These Terms of Service govern the contractual relationship between DMINC LLC and its customers for the sale of Google Merchant Center analysis services (Deban GMC), operated under the GClimb brand. DMINC LLC is a single-member Limited Liability Company organized under the laws of New Mexico, USA, registered with the New Mexico Secretary of State under file no. 3187822, with its registered office at 1209 Mountain Road Pl NE, Ste R, Albuquerque, NM 87110, USA. 2. Services Offered
GClimb offers automated e-commerce website analysis services to verify conformity with Google Merchant Center policies. Our services include: Deban GMC analysis, detailed report generation, automatic appeal letter creation, and assistance with suspended account recovery.
3. Pricing and Payment
Our service prices are displayed on our website in Euros (EUR) including tax. Payment is made online by credit card through our secure payment provider Stripe. Payment is due immediately upon order. GClimb reserves the right to modify its prices at any time, with the understanding that the price at the time of order will be the only applicable one.
4. Credit packs
GClimb is pay-per-use, with no subscription: the customer buys credit packs, and each analysis consumes a number of credits shown before it is started. Purchased credits accumulate and never expire. Payment is one-off, with no automatic renewal and no recurring charge.
5. Right of Withdrawal
In accordance with consumer protection laws, the right of withdrawal cannot be exercised for services fully executed before the end of the withdrawal period and whose execution began after the express prior consent of the consumer. However, GClimb offers a money-back guarantee: if your Google Merchant Center account is not unlocked after following our recommendations, we will refund you in full.
6. Results Guarantee
GClimb is committed to providing quality analysis and recommendations. Our money-back guarantee applies under the following conditions: (1) you have applied all recommended corrections, (2) you have submitted the generated appeal to Google, (3) your account has not been unlocked within 30 days of appeal submission. In this case, you can request a full refund by contacting our support.
7. Liability
GClimb makes every effort to provide a quality service. However, GClimb cannot guarantee the unlocking of your Google Merchant Center account, as this decision rests solely with Google. GClimb cannot be held responsible for decisions made by Google regarding your account.
8. Personal data and connection to Google services
DMINC LLC is committed to protecting your personal data in accordance with GDPR. The customer may optionally connect their Google Merchant Center account to enable the GMC Cross-Check feature. That authorization grants GClimb read access to the configuration of the customer's Merchant Center account, for the sole purpose of producing their audit report. Access tokens are encrypted and the customer can revoke the authorization at any time from their dashboard or from their Google account. 9. Intellectual Property
All content, reports, and analyses generated by GClimb remain the property of GClimb. The customer has a personal and non-exclusive right to use the reports generated as part of their subscription.
10. Modification of Terms
GClimb reserves the right to modify these Terms of Service at any time. New conditions will be applicable as soon as they are posted on the website. Customers will be notified by email of any substantial changes.
11. Disputes
In case of dispute, an amicable solution will be sought before any legal action. Failing that, French courts will have jurisdiction. The customer may also use a consumer mediator.
